I. Introduction

This dispute arises from the successful efforts of Tucson Unified School District (“TUSD” or the “District”) to expel Plaintiff Jeremy Magyar for bringing a knife to school. At the time of his expulsion, Jeremy qualified for special education services under the Individual with Disabilities Education Act (“IDEA”), 20 U.S.C. §§ 1400 et seq. (Supp.1996).
