This is an action to foreclose a real estate mortgage and for the appointment of a receiver pending proceedings.

Plaintiff’s petition filed January 15, 1943, for foreclosure of a mortgage, is regular in form. Defendant William A. Ehlers (appellant) claims to be the title holder by sheriff’s deed issued subsequent to appellee’s mortgage.
