After the submission of this appeal, plaintiffappellee died intestate on November 14, 1954, leaving as her only heir-at-law, Genevieve M. Vince. H. W. Marks was ap pointed administrator of the decedent’s estate on January 6, 1955. With the consent of all parties the said administrator and Genevieve M. Vince were substituted as appellees herein by order of this court on January 13,1955.
