Appellee, as plaintiff, brought suit against appellant, upon two causes of action. In the first he averred that he was a real estate agent and broker, carrying* on that business in the city of Denver, and as- such, engaged in selling and exchanging real estate; that defendant employed him to negotiate a sale of specified property to a Mrs. Fink, with the express understanding that no- commission should be paid for the sale, but that in the event the plaintiff would advise the grantee to construct a dwelling upon the premises sold, and a dwelling-house should be constructed thereon, and…
