FACTS
On October 31, 1982, plaintiffs’ decedent, Mercedes Banks, was arrested by the Emeryville City Police for public drunkenness. Ms. Banks was placed in a cell at the Emeryville Police Department Temporary Detention Facility. During the course of her detention, a fire broke out in her cell.
