Error from Atchison District Court. Action brought by Manson against the Railway Company, to recover damages sustained by plaintiff because of the failure of the defendant company to make and maintain certain cattle-guards. Trial at the June Term, 1883, and verdict and judgment for plaintiff for $300. The defendant brings the case here. The opinion states the facts.

The facts in this case are substantially as follows: On November 19,1881, the plaintiff below was the owner of the northeast quarter of section 32, township 5, range 19, in Atchison county; and on that day, with his wife executed to the defendant or its successors in interest, a deed for a,strip of land 100 feet in width across the said premises, *338being 50 feet on each side of the central line of the defendant’s railroad, as then located but not constructed.
