In this action brought pursuant to the Employee Retirement Income Security Act, 29 U.S.C. §§ 1001, et seq. (1999) (“ERISA”), plaintiff Wayne Urso (“Urso”) seeks to enforce payment of long-term disability benefits allegedly due under an employee welfare plan insured by defendant Prudential Insurance Company of America (“Prudential”). See 29 U.S.C. § 1132(a)(1)(B). Prudential objects, claiming Urso has received all the benefits to which he is entitled.
