This is an original application by the relator, M. H. Simons, for a writ of mandamus commanding the respondent, John F. Cornell, as auditor of public accounts, to *554issue to the said relator a warrant upon the state treasury in the sum of $250, on account of his salary as assistant clerk of the state banking board for the first quarter of 1897, at the rate of $1,000 per year. Prom the stipulation of the parties it appears that the respondent bases his refusal to issue the relator’s warrant as demanded upon the sole ground that the latter has failed to comply with the provisions of- the act…
