Curt Welwood sued Cypress Creek Estates, Inc. d/b/a Legacy Lakes Joint Venture (Legacy Lakes) and Blaekard Devel opments, Inc. (BDI) for negligence, breach of an implied warranty of good and workmanlike development sendees, and DTPA violations arising from damage to Wel-wood’s personal property at his residence allegedly caused when the slope behind the house failed.
