The assignment of errors in this case contains thirty different specifications. The important ones, *513however, may be condensed into two general questions, as follows: First. Was appellee, The Union Depot and Bailroad Company, at the commencement of this suit, a corporation duly organized and existing under the laws of Colorado? Second. Is the patent through which appellee claims, conveying title of the original Denver town site from the United States to Hall, probate judge, in trust, absolutely void?
