I. INTRODUCTION

On September 26, 1991, Appellant, Fina Oil and Chemical Company (“Fina”), brought suit against Appellees, Port Neches I.S.D. (“School District”), Jefferson County Education District (“Education District”) and Nick Lampson (“Lampson”), Tax Assessor-Collector for the School District and Education District, in the 172nd District Court of Jefferson County, Texas.
