POPE, Justice.

Appellant, the plaintiff below, appeals on the ground that the' jury was guilty of misconduct. Appellant sued for damages arising out of personal injuries sustained in a railroad accident, and the jury found against him both on the negligence 'and unavoidable accident issues. The controlling point urged in this case is whether prejudicial misconduct resulted when two jurors allegedly stated during deliberations, that findings on the negligence and unavoidable accident issues were immaterial after the damage issue was answered, and as a consequence of which two other jurors…
