MEMORANDUM OPINION
JOHN C. FORD, Bankruptcy Judge.
On February 13, 1985, Debtor, Fresh Approach, Inc. (hereinafter “Debtor”), filed its petition for relief under Chapter 11 of the Bankruptcy Code. Debtor operated, and continues to operate as Debtor-in-Possession, a market featuring a variety of fresh produce and groceries. In the course of its operations, Debtor had obtained from the United States Department of Agriculture, Defendant herein, a license to buy and sell produce pursuant to the provisions of the Perishable Agricultural Commodities Act of 1930, 7 U.S.C. 499a et seq.
