MEMORANDUM OPINION AND ORDER GRANTING MOTION TO DISMISS

BEFORE THE COURT is the Motion to Dismiss [4] filed by the Defendant, the United States of America. The Motion has been fully briefed by the parties. After due consideration’of the submissions and the relevant law, the Court finds that it lacks subject matter jurisdiction of this case.
