In this action to foreclose a second mortgage for $50,000, the Appellate Division reversed an order denying defendants’ motion to vacate a default judgment and remanded it for a hearing and determination of “ whether the court had jurisdiction to entertain this foreclosure action in the first instance under section 1301 of the Real Property Actions and Proceedings Law.” (34 A D 2d 658, 659.)
