Plaintiff appeals as of right from the trial court’s order granting defendant’s motion for summary disposition. The motion was brought under MCR 2.116(C)(8) and (10). We affirm.
Plaintiffs decedent, Dellia Myles, drowned in her bathtub. Plaintiff alleges that the decedent was a resident of the Jeffries Projects, a low-income housing facility owned and operated by the defendant city. Further, plaintiff alleges that the decedent "slipped and fell in the bathtub and/or bathroom, when the supporting railing affixed near said bathtub broke and/or disconnected,” causing wrongful death.
