This matter came on to be heard before the Honorable James Connell on the Petition to Review of the Order of the Referee in Bankruptcy holding that the agreement entered into by and between the bankrupt and the Noll Equipment Company, the respondent herein, was a conditional sales contract, and not a lease and that failure to record said conditional sales contract, it was void as to the Trustee, on the Certificate of Review filed by the Referee, William B.
