COFFEY, Circuit Judge.

On May 19, 1983, a federal grand jury returned an indictment charging the defendant Rourke with one count of conspiracy to possess with intent to distribute in excess of 1,000 pounds of marijuana, in violation of 21 U.S.C. § 846, and one count of conspiracy to import marijuana into the United States, in violation of 21 U.S.C. § 963. Rourke entered into a plea agreement and pled guilty to the charge of conspiracy to possess with intent to distribute marijuana.
