This cause is before the court on the motion of defendants United States of America and the United States Department of Homeland Security (collectively the Government) to dismiss, or in the alternative for summary judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure. As the motion was premised in part on sovereign immunity, the court, upon the Government’s filing of the motion, entered an order staying the case pending resolution of the motion.
