Appeal from judgment' on report of referee. Action by William E. Sabin against William A. Kendrick. From a judgment for plaintiff on the decision of a referee, defendant appeals. Reversed.

This action was brought to recover a balance alleged to be due the plaintiff for services rendered under a written contract. " There have been three trials. On the first, the result was unsatisfactory to both parties, and the verdict was, by consent, set aside. On the second, the complaint was dismissed, but on appeal the judgment was reversed, and a new trial ordered. Sabin v. Kendrick, 55 App. Div. 443, 55 N. Y. Supp. 840.
