Reversing.

In May, 1943, the grand jury of Hopkins county, Kentucky, returned an indictment against appellant, charging him with voluntary manslaughter. The indictment charged, in substance, that the appellant did unlawfully, wilfully, feloniously, and in a negligent, reckless, careless and wanton manner, while driving an automobile on the public highway about two miles from Madisonville, Kentucky, kill Virgil Welborn by driving the automobile in which he and Welborn were riding in such a careless, negligent, reckless and wanton manner, and at a high rate of…
