Appeal from a judgment of the Supreme Court (Ceresia, Jr., J.), entered October 25, 1996 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondents’ motions to dismiss the petition for lack of standing.

On July 2, 1996, respondent Department of Health issued a “corrected” ambulance service certificate to respondent Twin City Ambulance Corporation (hereinafter TCA) permitting it to operate in Niagara and Erie Counties.
