BELL, Chief Justice.

This is an appeal from a summary judgment rendered in favor of appellee declaring that appellee is entitled to "one-half of the net profits having accrued and to accrue from the following described land, * * Then follows a statement that it applies to an undivided 192.057 acre interest out of a specifically described 1729 acres in Chambers County.
