The defendant, Floyd Akers, was charged by information filed in the county court of Jackson county with the unlawful possession of intoxicating liquor, was tried, convicted and sentenced to serve 30 days in the county jail, and pay a fine of $100 and costs, and has appealed.
It is contended that the trial court erred in overruling the motion to suppress evidence filed and presented by the defendant prior to the commencement of the trial.
