MEMORANDUM AND ORDER
PLATT, Chief Judge.
Defendant has moved to dismiss the complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the reasons set forth below, defendant’s motion is denied.
BACKGROUND
In November, 1984, plaintiff was appointed to the administrative position of Director of Pupil Personnel Services (“DPPS”) by the defendant Board of Education of the Hempstead School District (“Board”).
