The defendant was indicted for the murder by poisoning of one Lizzie M. Cook. The trial resulted in a verdict of guilty of manslaughter. Before sentence, the defendant filed a motion to set aside the verdict upon the ground, among others therein stated, that it was against the evidence. This motion, after hearing, was denied, and the defendant excepted. Thereafter, the defendant filed a motion to set aside the verdict and for a new trial on the ground of newly discovered evidence.
