delivered the opinion of the court.

This is an action on the case brought by appellee against appellant to recover damages for injuries received by appellee, on account of the negligence of the servants of appellant in leaving open a certain switch, connecting with a lead track in the freight yards of the Clover Leaf Bail road, in East St. Louis, whereby appellee was severely injured by a collision of the cars.
