This is an action on a promissory note, secured by mortgage, payable in five years from the date of its execution, which was August 5, 1926, to the Beacon Trust Company of Boston, as payee. The note was signed as maker by the defendant, Max Siegel, whose signature appeared to have been witnessed by Julius I. Berns. As the evidence so clearly warrants the finding of the trial judge that the note was signed by the maker in the presence of Berns and duly attested by him, we give no further consideration to this question.
