This is a replevin action to determine the ownership and right to possession of a secondhand Chrysler automobile. From a judgment in favor of the defendant, plaintiff appeals, predicating error on the refusal of the court to instruct the jury, as a matter of law, that plaintiff was the owner and entitled to possession of the automobile in question and that the only issue of fact for it to determine was the amount of damages plaintiff had sustained by reason of the alleged wrongful detention of the automobile. Under this assignment of error it is necessary to recite the facts.
