O’Bbien, J..This was an action to determine the validity of a written instrument produced as the last will of Anna Sutherland, who died on the 16th day of September, 1897. It was admitted to probate by the surrogate after a contest. The plaintiff is the daughter and only child of the deceased, and this action was brought by her under the provisions of section 2653a of the Code of Civil Procedure.
