The complaint in this action is addressed to this court as a court of equity, and prays a perpetual injunction to restrain the collection of a tax for the year 1850, imposed upon the defendant as the owner of personal property within the city and county of New-York, for the collection of which a warrant has been issued by the defendant, Hart, as Beceiver of Taxes for the city and county of New-York, directed to the defendant, Jenkins, a constable; in pursuance *5of which, the latter has distrained certain property of the defendant, and is proceeding to sell the same for the collection of such…
