The plaintiffs are successors in interest to the previous partnership of J. W. and N. L. Terteling (hereinafter referred to as the contractors), which partnership had also been engaged in business under the firm name of J. A. Ter-teling & Sons. They seek in this action to recover from the govermnent the costs and expenses incurred by the contractors in successfully defending law suits brought against them by third parties, the owners of certain lands in Idaho.
