GRAVES, Judge.
Appellant was convicted of the unlawful killing of Aubrey Lee Capps without malice, and by the jury condemned to serve a term of five years in the penitentiary.
The facts show that appellant and the deceased had engaged in some kind of argument in a cafe in the town of Glade-water on August 19, 1944, at which place they were separated and appellant was taken in charge by officers, and caused to make bond, charged with a disturbance (of the peace).
