The plaintiff sued for damages for breach of a covenant in a lease between the parties. At the close of plaintiff’s case, upon defendant’s motion, the court directed a verdict in favor of plaintiff for nominal damages of six cents. Plaintiff appeals. The judgment must be reversed and a new trial granted for the following reasons:

The defendant rested upon the plaintiff’s case and moved for the direction of a verdict in plaintiff’s favor, thereby conceding the facts to be in accordance with the plaintiff’s testimony, and also conceding that there was a breach of the contract by the defendant.
