Many years ago the respondent’s predecessor erected a highway bridge over its track in the village of Morristown, St. Lawrence county. This was done pursuant to the provisions of sections 24 and 28 of chapter 140 of the Laws of 1850, later incorporated in section 11 of chapter 565 of the Laws of 1890 and now embodied in subdivision 4 of section 8 and section 21 of the Railroad Law. These statutes permitted a railroad corporation to construct its railroad across a highway which the route of the railroad intersected and directed it to restore the highway thus intersected to its former state or…
