This is an original application presented by the relator, I. H. Ham-monds, county treasurer of Titus county, for a writ of mandamus compelling the honorable J. A. Ward, judge of the Seventy-Sixth Judicial district of Texas, to set aside an order made by him upon an application presented in vacation, and to set down for trial before a jury a pending suit which will be hereafter more fully explained.
