Defendant, in the Court of General Sessions of the County of New York, was convicted of the crime of robbery in the first degree and sentenced to State prison for not less than ten nor more than twenty years. The indictment charged defendant with robbery, assault, grand larceny, and receiving stolen goods, but the case was submitted to the jury only on the count chargmg robbery m the first degree.
