This was debt by attachment, brought by Peet, Simms & Co., against the plaintiff in error, in the Jefferson Circuit Court, on a promissory note. The declaration is in the usual form, and is not involved in the enquiry invited by the assignment of errors. The errors assigned relate to the affidavit on which the attachment issued, the bond for cost filed in the Court below,in consequence of the defendants in error being non-residents of this State at the time of the commencement of the suit, the attachment bond and the writ itself.
