This case is before us on appeal from an order of a justice of the Superior Court vacating a final decree which he had rendered on a bill in equity brought by the present defendant against the petitioner and his wife.

This defendant, a municipal corporation, on July 31, 1945 filed a bill in equity against the petitioner and his wife seeking a mandatory injunction to compel them to remove from a building alleged to be owned by them in the City of Bidde*337ford certain materials added to the outside walls of the building.
