After this case was argued in this court, an act entitled, “An Act in Relation to Courts of Review,” chapter 107, Session Laws of 1911, became effective, and the court of appeals was established thereunder. The cause was thereupon transferred to that court by the terms of the act. It, however, was re-transferred here, as involv*283ing constitutional questions, and we will, therefore, proceed to determine the matters presented.
