The plaintiff in error was convicted under an accusation charging a violation of § 349 of the Penal Code (1910), and excepts to the refusal of a new trial. The accusation alleged that the accused pointed and aimed a pistol at William Bone and E. B. Corey. There is some evidence which indicates that the defendant might perhaps have been held justifiable in pointing the pistol in defense of her habitation and her children, but we pass this phase of the case, because there is sufficient evidence to have authorized the conviction of the defendant for unlawfully pointing and aiming a pistol at…
