The complaint alleges that a certain mortgagee of premises was insured against loss by fire; that said mortgagee was in possession of the bond and mortgage at the time of the destruction of the premises by fire; that thereafter there was an assignment of the bond and mortgage and also an assignment of all right, title and interest in and to the said policy from the mortgagee to plaintiff.
