RATLIFF, Judge.

STATEMENT OF THE CASE

Appellant Connie Ann Tapp (Tapp) appeals from a conviction of the crime of battery, a class D felony, and from a two year sentence to the Indiana Women’s Prison.

FACTS

The facts most favorable to the state are as follows. On April 14, 1979, off duty Evansville police officer, Bertus Weisheit (Weisheit), was working as a plainclothes security guard at the North Park Sears store in Evansville, Indiana.
