Appeal from a judgment of the County Court of Columbia County (Leaman, J.), rendered June 8, 1987, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the fifth degree.

In February 1987 defendant was charged in a two-count indictment with criminal sale of a controlled substance in the third degree, a class B felony, along with a misdemeanor possession charge. Pursuant to a negotiated agreement, defendant pleaded guilty to a reduced charge of criminal sale of a controlled substance in the fifth degree, a class D felony, in exchange…
