Both parties derive their claim to the land in ques tion from John Snell, who was the owner and seised thereof in fee. The plaintiff, who was also the plaintiff below, claims it as a purchaser at sheriff’s sale, made under an execution, sued out upon a judgment in favour of Jacob K. Boyer, after it had been assigned by Jacob K. Boyer to Isaac Boyer, against Snell.
