Reversing.

This is an appeal from a judgment convicting appellant of the mnrder of Tom Blackburn, and fixing his punishment at life imprisonment.

The homicide occurred at a coal camp near Garrett, in Floyd county, on the night of October 31, 1926. Just prior to the homicide Blackburn, the peace officer, and Verlie Banks were looking after some oil tanks of the coal company. While there, they heard some shooting at the coal camp.
