The petition contained two counts. In the first count it was alleged, that the defendant authorized the firm of Brown & Eoberson, by telephone and by writing, to draw on the defendants for the sum of $100, and defendant would pay the draft so drawn; that they drew the draft, and that the plaintiff, relying on the telephone conversation and the written authority from the defendant,' bought the draft from Brown & Eoberson, paying value therefor, and without knowledge of any equities existing between the parties or of any reason why the defendant should not pay the draft.
