Technology for Energy Corporation (TEC), the debtor-in-possession, and its principal lender, First American National Bank (FANB), seek approval of a settlement fixing the amount of FANB’s secured claim and releasing FANB from all claims TEC may have against the bank, including claims: (1) to avoid preferential transfers; (2) to equitably subordinate FANB’s claims; and (3) for damages resulting from alleged economic duress.
