This appeal stems from plaintiff-appellant Francisco Garcia’s dismissal from a New York state medical school, the State University of New York Health Sciences Center at Brooklyn (“SUNY”), following his repeated failure to successfully complete the first-year medical school curriculum. After his dismissal, Garcia visited a *104psychologist who subsequently diagnosed him as having attention deficit disorder and a learning disability.
