CRAWLEY, Judge.

George S. Leatherbury (the “worker”) sued Office Supplies, Inc. (the “company”), for workers’ compensation benefits, alleging that he had been injured in the line and scope of his employment and as a result had suffered a permanent disability. The company asserted two affirmative defenses. The company argued that the worker was not an employee of the company. The company also argued that the worker had been intoxicated at the time of his accident and that his intoxication proximately caused his accident.
